Informed Consent and Release Form

Participating (whether simply attending, observing or actively participating) in the Graland Gallop 5k Run/Walk includes a risk of injury, and that it is impossible to fully eliminate this risk. The following describes some, but not all of the inherent and other risks, hazards and dangers of the Graland Gallop 5k Run/Walk: interaction with others, including exposure to bacteria, viruses or other pathogens, including but not limited to the novel coronavirus association with COVID 19, and decision making and conduct; personal health conditions; frequent and repetitive use of the arms and legs; loss of control, tripping and falling and/or colliding with others, the ground, rocks or trees; encountering water/terrain/road/trail/other hazards; failing to negotiate steep, uneven or difficult terrain; and ruts, slippery walkways, uneven ground or other conditions. I am aware of and acknowledge that the risks arising from or in connection with participation in the Graland Gallop may result in claims by me or Child(ren) against Graland Country Day School (“Graland”), its owners, directors, officers, trustees, employees or agents (hereinafter “Graland and those associated with Graland”).

I further acknowledge that absent my agreement to the terms of the Informed Consent and Release Agreement on behalf of myself and Child(ren), Graland could not afford the liability risks associated with our participation in the Graland Gallop. I specifically acknowledge Graland’s reliance upon the execution of this Informed Consent and Release Agreement in permitting me and/or Child(ren) to participate in the Graland Gallop.

In consideration for myself and Child(ren) being permitted to participate in the Graland Gallop, I, on behalf of myself and Child(ren), voluntarily assume all risks in connection with participation in the Graland Gallop. As further consideration, I, on behalf of myself and Child(ren), hereby exempt, release and discharge Graland and those associated with Graland from any and all liability, costs, damages, claims, demands, actions or causes of action whatsoever arising out of any damage, loss, illness or injury to me or Child(ren), or my or Child(ren)’s property, from participation in the Graland Gallop including, but not limited to the negligent acts and omissions of Graland and those associated with Graland. I voluntarily agree to indemnify and hold Graland and those associated with Graland harmless from any and all liability, costs, damages, claims, demands, actions or causes of action whatsoever, including attorneys’ fees and costs, arising from any harm, injury, illness, damage, or loss to myself, Child(ren), any other person, or property, I or Child(ren) may cause as a result of participation in the Graland Gallop. I further agree that I have not now and will not at any point in the future commence any action, suit or other proceeding against Graland seeking to recover for one or more of the claims released herein, either on behalf of myself or on behalf of Child(ren).

I certify that I have carefully read this document, that I fully understand its terms and conditions and that I have signed it voluntarily and willingly.
